Kingfisher Bay Resort on Fraser Island has been hit with a massive negligence payout following a client’s stair fall. Justice Peter Lyons found Kingfisher Bay Resort was negligent in not maintaining the stairs in a safe condition as they became slippery when wet.

At the Supreme Court in Brisbane on May 18, Justice Lyons awarded Robert Corkery and his wife a total of $904,213 in damages. Mr Corkery, a geological consultant from NSW, fell in January 2002 while on holiday celebrating his 50th birthday and stated that, following his injuries, was unable to carry out geological investigation field work. He spent a week in hospital and was off work for two months but still suffered back problems.

Mr Corkery’s wife, Cynthia, claimed damages for “loss of consortium” following the accident.
